Terms of Service Usage
This Terms of Service Agreement (“Agreement”) is a legal contract between PerLod (“we,” “us,” or “our”) and the customer (“you” or “your”), including individuals or entities using our services. By registering, placing an order, or using our services, you agree to be bound by this Agreement. If you act on behalf of a company or legal entity, you confirm that you have the authority to bind that entity to this Agreement.
1. Definitions
- Services: Any hosting, VPS, Dedicated Server, GPU Server, or related services provided by PerLod.
- Account: A unique PerLod user account associated with a verified email address.
- Customer Content: All data, files, applications, or content uploaded, stored, or transmitted via PerLod services.
- Billing Cycle: The recurring payment period selected for a service.
- AUP: Acceptable Use Policy governing permitted usage of PerLod services.
2. Eligibility & Account Responsibilities
- Each account must be unique and associated with a single individual or company.
- Duplicate or fraudulent accounts may be suspended or deleted.
- You are responsible for maintaining the confidentiality of your account credentials.
- All services must comply with local laws, regulations, and this Agreement.
3. Acceptable Use Policy (AUP)
You agree not to use PerLod services to:
- Engage in illegal activities or violate local, national, or international law.
- Host malware, hacking tools, phishing schemes, or other malicious software.
- Distribute spam or operate unauthorized bulk mailing.
- Host prohibited content including adult content, gambling, or financial fraud.
- Abuse resources or negatively impact other users or PerLod infrastructure.
Violation of the AUP may result in immediate suspension or termination of services.
4. Service Provisioning & SLA
- VPS services are provisioned within 30–45 minutes of purchase.
- Dedicated and GPU servers are provisioned within 5–10 business days.
- PerLod provides no unconditional guarantee of uptime but will strive to maintain industry-standard reliability.
- Customers are responsible for backups; PerLod is not liable for lost data.
5. Billing & Payments
- All prices are listed in USD, unless otherwise stated.
- Services must be renewed by the due date to avoid suspension or termination.
- PerLod may modify pricing with prior notice via email or platform announcement.
- Refunds are processed according to the Refund Policy (see Section 8).
- Payments via digital currency must comply with accepted coins and blockchains only.
6. Refund Policy
Refunds may be requested if:
- Service specifications do not match advertised features within 5 days of activation.
- Technical issues arise that PerLod cannot resolve.
Notes:
- Domain registration fees are non-refundable.
- Refunds under $50 are credited to the PerLod wallet.
- Refunds are processed within 20–50 business days.
- Refunds via digital currency are credited only to the PerLod wallet.
- Wallet credits are non-refundable.
7. Customer Responsibilities
- Implement strong passwords and appropriate security measures.
- Maintain all backups and ensure proper usage of allocated resources.
- Comply with all applicable laws in their jurisdiction.
8. Dedicated Server & GPU Server Policies
- BIOS or firmware modifications are strictly prohibited.
- Bandwidth or resource overuse may result in suspension unless additional fees are paid.
- Servers are provisioned with specific configurations; migration is not guaranteed.
- Customers are responsible for internal service performance.
9. Abuse & Compliance
Services may be suspended or terminated for:
- DDoS attacks, malware, phishing, or spamming.
- Hosting illegal, pirated, or restricted content.
- Fraudulent schemes or unauthorized services.
- Impersonation of brands or third parties.
All reports of abuse should be sent to ab***@****od.com. Customers remain responsible for activities conducted through their services.
10. Limitation of Liability & Indemnification
- PerLod’s liability is limited to the amount paid by the customer in the last 12 months.
- PerLod is not liable for indirect, consequential, or incidental damages, including data loss or service downtime.
- Customers agree to indemnify and hold PerLod harmless from claims, damages, or expenses arising from their use of services.
11. Force Majeure
PerLod is not liable for delays, service interruptions, or failures due to events beyond our reasonable control, including natural disasters, power outages, or network failures.
12. Termination
- Services may be terminated for non-payment, AUP violations, or illegal activity.
- Termination notices will be communicated via email.
- No refunds are guaranteed upon termination due to violations.
13. Updates to this Agreement
PerLod may modify this Agreement at any time. Material changes will be communicated through the website or email. Continued usage after updates constitutes acceptance.
14. Privacy & Data Protection
By using our services, you agree to our Privacy Policy and Cookie Policy. For EU customers, GDPR compliance is enforced.
